Reforms


The Ivorian Government has committed since 2012, with the support of technical partners, including the World Bank through the IFC (International Finance Corporation), the process of improving the business climate through several reforms of the macroeconomic framework and sectoral framework of activities.

Doing Business is a repository of the World Bank that assesses the regulation of the private sector including small and medium companies on the 11 stages of their life cycle. Steps presented as the following indicators:

 The Doing Business Indicators

    1.  Business creation

Doing Business records all procedures officially required for an entrepreneur, or commonly performed during the creation and management of a formal business enterprise, as well as the time and cost required to complete and finally the payment of the minimum capital demand. These include obtaining all licenses and all necessary permits, and, with the authorities concerned, all formalities required for the company and its employees, including notifications, verifications or inscriptions.     2.  Obtaining building permission

Doing Business records all procedures to be performed by a construction company wishing to build a warehouse. These procedures include obtaining and filing with the competent authorities all the required documents for this specific project (eg building architectural plans and location plans); obtaining all permits, authorizations, licenses and certificates prescribed; hiring supervisors, engineers and external inspectors if necessary, observing all the obligations of notification and inspection (if inspections are not conducted by a private external inspector). Doing Business also covers the procedures to be connected to water networks and sewage. Procedures necessary to update the title, so that it can be used as collateral or be a mutation in favor of another entity are also counted. Click here for more Information

 

    3.  Connecting to electricity

Doing Business records all procedures that a company must do to obtain a permanent electricity connection and supply of a standardized warehouse. These procedures include applications filed with the electricity companies and contracts with them, all inspections and approvals to be sought from power companies or other organizations as well as the connection work and commissioning Service.     4.  Transfer of ownership

Doing Business traces the full sequence of procedures to be performed by a company (the acquirer) to buy a property to another company (the seller), and to transfer the title of the property on behalf of the purchaser, so that it can use that property for the expansion of its business, as a guarantee to underwrite new loans or, if necessary, transfer ownership to another company. The process begins with obtaining the necessary documents, a copy of the title from the seller, for example, if required, and includes the exercise of due diligence, if necessary. The transaction is considered complete when the title is enforceable against third parties and when the buyer can use the property as collateral for a bank loan or sale. Click here for more information

 

    5.  Getting Credit

Doing Business measures the legal rights of borrowers and lenders in secured transactions through a set of indicators, as well as the sharing of credit information by another indicator. The first set of indicators is investigating whether certain measures facilitating loans exist within the laws applicable in the collateral and bankruptcy. The second set measures the coverage, scope and accessibility of information on available credit by credit reporting agencies, such as credit bureaus or credit registries. Click here for more Information

 

    6.  Protecting Investors

Doing Business measures the level of protection of minority investors in case of conflict of interest by a set of indicators and the rights of shareholders in corporate governance. Click here for more information

 

    7.  Taxes payment

Doing Business records the taxes and mandatory contributions that a medium-sized company must pay or deductions to it every year, and evaluates the administrative steps required for payment. The taxes and fees listed include: the income tax or corporate income, social contributions and labor taxes paid by the employer, property taxes, transfer taxes, tax dividends, the tax on capital gains, the tax on financial transactions, the garbage collection fee and taxes on motor vehicles and road taxes and small taxes, fees or costs. Click here for more Information

 

    8.  Cross-border trade

Doing Business records the time and cost (excluding customs duties) associated with exporting and importing a standardized cargo of goods by sea. All deadlines and formal procedures cost of export and import are identified, however, the time and the shipping costs are excluded. In addition, all documents which the operator needs to export or import the goods are recorded. In terms of exports, procedures begin with the condition of the goods in the container to the warehouse and end at the time of shipment from the port of export. For importing goods, procedures range from the vessel arrived at the port for delivery of goods in the warehouse. For landlocked countries, the procedures at the border to the interior are included, since the port is located in another country. Payment is made by letter of credit, and taking into account the time, cost and documents required for the issue or transfer of a letter of credit. Click here for more Information

 

    9.  Enforcing Contracts

Indicators on enforcing contracts measure the efficiency of the judicial system for resolving a commercial dispute. The data are built by following the step-by-step evolution of a dispute of non-payment of commercial debt in local courts. Data were obtained from the study of codes of civil procedure and other court regulations, as well as from surveys of judges and specialized local litigation lawyers.     10.  Regulation of insolvency

Doing Business studies the time, cost and outcome of insolvency proceedings for domestic firms. In addition, a new measure is introduced this year namely, the index on the strength of the legal framework of insolvency and to assess the strength and integrity of the legal framework for liquidation and recovery court. The data for the indicators on the regulation of insolvency were obtained from the survey responses provided by lawyers and local administrators, and verified through a study of laws and regulations, as well as information public concerning the insolvency proceedings. Click here for more Information
